Standing Committees (Section 162, 162 A)
As per the Kerala Panchayat Raj Act, 1994, Standing Committees exist in every Panchayat. Standing Committees serve as a support mechanism for the Panchayat to execute its responsibilities efficiently, effectively, and in a time-bound manner across the sectors of development, welfare, and basic infrastructure.
The Panchayat must carefully and thoroughly examine any matter before taking a decision. This examination should first be conducted by the respective Standing Committee. Matters should be included in the agenda of the Panchayat meeting only after being discussed and decided upon in the Standing Committee meeting. If the Panchayat takes a decision on a matter included in this manner, the concerned Standing Committee is also responsible for ensuring that the decision is implemented efficiently. Resolutions passed by the Standing Committee must be presented at the next meeting of the Panchayat. The Panchayat has the authority to make modifications if necessary. The Secretary must attend all Standing Committee meetings and make necessary arrangements to record the minutes and decisions.
Structure of the Standing Committee
- Only elected representatives are members of the Standing Committees. Every member, except the President and the Vice President, is an elected member of at least one Standing Committee.
- A member shall not be a member of more than one Standing Committee.
- Each Standing Committee must mandatorily have at least one female member.
- Except for the Finance Standing Committee, all other Standing Committees shall have a Chairperson elected from among their respective committee members.
- The Vice President shall be the Chairperson of the Finance Standing Committee.
- The President is an ex-officio member without voting rights in all Standing Committees, whereas the Vice President shall be an ex-officio member with voting rights and the Chairperson of the Finance Standing Committee. (Section 162(6))
Duties and Responsibilities of the Standing Committee
All elected representatives are made part of a Standing Committee to entrust the duties and responsibilities of the Panchayats among all members. The responsibilities rest with the Panchayat as a whole, and not with any individual or committee. Several mechanisms are incorporated within the administrative system to carry out the responsibilities of the Panchayat, the most important of which are the Standing Committees. All responsibilities vested in the Panchayat are distributed among various Standing Committees. Therefore, the Panchayat must fulfill its duties through these Standing Committees. Standing Committees are not independent bodies, nor do they possess independent authority. When each Standing Committee performs the duties assigned to it by law on behalf of the Panchayat, governance becomes efficient, ensuring participation and decentralization.
All decisions taken by the Standing Committees must be presented at the next meeting of the Panchayat. The Panchayat has the authority to modify the decisions if required. (Kerala Panchayat Raj Act, 1994, Section 162A(3)).
Standing Committee Meetings (Kerala Panchayat Raj (Standing Committee) Rules, 2000)
- The committee must meet at least once a month.
- Meetings should be held at the Panchayat Office on the date and time fixed by the Chairperson.
- The respective Standing Committee should consider matters related to the responsibilities of the Panchayat. If different Standing Committees take conflicting decisions on the same topic, the matter should be submitted to the Panchayat for consideration.
- The quorum for the meeting shall be three. However, if the number of voting members is four or fewer, the quorum shall be two.
- Decisions on agenda items shall be made by a majority vote of the members present.
- The presiding officer shall have a casting vote.
- The date of the meeting and the agenda topics must be informed to the President, who is an ex-officio member, and must also be published on the notice board.
- A decision of a Standing Committee can be amended or canceled only through a specially convened meeting supported by a resolution passed by more than half of the total members assigned to that Standing Committee. Such amendments must be made within three months.
The role of Standing Committees is crucial in the execution of local government duties. Only when Standing Committees efficiently discharge their designated responsibilities will local governance become effective, logical, and scientific.
