Standing Committees (Section 162, 162A)
As per the Kerala Panchayat Raj Act, 1994, Standing Committees exist in every Panchayat as detailed below. Standing Committees serve as a support system for the Panchayat to execute responsibilities in the development, welfare, and infrastructure sectors effectively, efficiently, and in a time-bound manner.
Before taking a decision on any matter, the Panchayat must examine it carefully and in detail. This examination should be initially conducted by the respective Standing Committee. Matters should be included in the agenda for the Panchayat meeting only after discussions and decisions are held in the Standing Committee meeting. Once the Panchayat makes a decision regarding a matter included in this manner, the concerned Standing Committee is also responsible for ensuring that the decision is implemented effectively. Resolutions passed by the Standing Committee must be presented at the next meeting of the Panchayat. The Panchayat has the authority to make changes if necessary. The Secretary must attend all Standing Committee meetings, and arrangements must be made to record minutes and decisions.
Structure of the Standing Committee
- Only elected representatives are members of the Standing Committees. All members, except the President and Vice President, are elected members of at least one Standing Committee.
- A member shall not be a member of more than one Standing Committee.
- There must compulsorily be one female member in each Standing Committee.
- The President is an ex-officio member of all Standing Committees without voting rights, whereas the Vice President shall be an ex-officio member with voting rights and the Chairperson of the Finance Standing Committee. (Section 162(6))
Duties and Responsibilities of the Standing Committee
Everyone is made a part of some Standing Committee as part of distributing the duties and responsibilities of the Panchayats among all members. The responsibilities belong to the Panchayat, not to any individual or committee. Numerous mechanisms are incorporated within the administrative framework to fulfill the duties of the Panchayat. Standing Committees are the most important among them. All duties vested in the Panchayat are divided among the various Standing Committees. Therefore, the Panchayat must fulfill its responsibilities through various Standing Committees. Standing Committees are not independent systems, nor do they have independent powers. When each Standing Committee executes the duties assigned by law on behalf of the Panchayat, the administrative mechanism becomes efficient, bringing about participation and decentralization.
All decisions taken by the Standing Committees must be presented in the next meeting of the Panchayat. The Panchayat has the authority to amend decisions if necessary. (Kerala Panchayat Raj Act, 1994, Section 162A(3)).
Meetings of the Standing Committees (Kerala Panchayat Raj (Standing Committee) Rules, 2000)
- Meetings must be held at least once a month.
- The meeting shall be held at the Panchayat office at the date and time fixed by the Chairperson.
- The respective Standing Committee should consider subjects related to the duties of the Panchayat. In case different Standing Committees take contradictory decisions on the same subject, the matter shall be submitted for the consideration of the Panchayat.
- The quorum for the meeting shall be three. However, if the number of voting members is four or fewer, the quorum shall be two.
- Decisions on agenda items shall be made by a majority vote of the members present.
- The presiding officer shall have a casting vote.
- The meeting date and agenda items must be communicated to the President, who is an ex-officio member, and published on the notice board.
- A decision of a Standing Committee can be modified or cancelled only at a specially convened meeting through a resolution supported by more than half of the members prescribed for the Standing Committee. Such amendments must be made within three months.
The role of Standing Committees is crucial in the discharge of duties of local self-governments. Only if Standing Committees efficiently carry out the responsibilities assigned to them will local governance administration be effective, logical, and scientific.
