The Panchayat Level Grievance Redressal Committee is a committee formed to receive, examine, and resolve grievances of the people in the Grama Panchayat related to administration or services. Its primary objective is to ensure speedy and transparent justice to the public. The public can submit their grievances either online or directly.

Structure of the Committee

    • Chairpersons of Standing Committees
    • Panchayat Secretary
    • Concerned Officers
    • An Implementing Officer capable of providing expert advice on the subject area related to the complaint
    • The Member representing the Ward related to the complaint

2. Ombudsman

The Ombudsman is a state-level quasi-judicial institution constituted to hear and redress grievances regarding corruption, maladministration, and irregularity of Local Self Government Institutions and their elected representatives or officials. A retired High Court Judge is appointed as the Ombudsman by the Governor. The procedures are different from other courts and are simple. Ombudsman is the most cost-effective mechanism for the public to resolve grievances.

Powers

  • Investigate allegations and pass orders.
  • Pass interim orders restraining the Local Self Government Institution from specified actions.
  • Impose compensation and penalties.
  • Powers vested in a Civil Court for trying a suit under the Code of Civil Procedure, 1908.
  • Power to requisition the services of any government officer, including police officers.

Duties

  • Redress the grievances of the public.
  • Sanctify and improve the system of administration in Local Self Government Institutions.
  • Conduct thorough investigations regarding complaints contained in a petition, referred by the government, or brought to the knowledge of the Ombudsman.

Matters Outside the Jurisdiction of the Ombudsman

  • Matters in respect of which the Government has formally and publicly ordered an inquiry.
  • Matters that need to seek redressal from the Appellate Tribunal for Local Self Government Institutions.
  • Matters pending before a court under the Commissions of Inquiry Act, 1952.
  • Complaints filed after 3 years from the date on which the alleged act took place (however, complaints may be accepted if there are sufficient reasons for not filing on time).

3. Tribunal

The Tribunal is a judicial mechanism for filing appeals/revision petitions against the decisions of Local Self Government Institutions. The judge is a judicial officer holding the rank of a District Judge. The Government appoints the Tribunal in consultation with the Chief Justice of the High Court. Tribunals have the power to examine disputes between Local Self Government Institutions themselves or between them and the Government and convey opinions to the Government.

Powers

  • Powers vested in a Civil Court under the Code of Civil Procedure, 1908 while trying a suit.
  • Any proceeding before the Tribunal shall be deemed to be a judicial proceeding within the meaning of the Indian Penal Code.
  • Interim orders may be issued to stay proceedings upon application by the petitioner.
  • Power to issue necessary directions to Local Self Government Institutions.

Things to Note When Filing a Petition with the Tribunal

  • A certified copy of the petition and related documents, along with a Bank Draft of ₹50 in the name of the Tribunal, must be sent. Additional copies must be provided depending on the number of respondents.
  • Appeals should normally be submitted within 30 days. However, if there are sufficient reasons, appeals/revisions can be submitted up to one month after this period.
  • In matters filed before Local Self Government Institutions that have not been disposed of within 60 days, revisions/appeals can be submitted to the Tribunal within 90 days. However, if there are sufficient reasons, appeals/revisions can be submitted within one month after this time limit.
